These terms of service (the "Terms") govern access to and use of the Jack & Mani game, offered as a web version (from your browser) and as an app you can download from the app stores, published by Maurice Hurdebise (independent entrepreneur, trade name "Jack & Mani"). The publisher's full identity appears in our legal notice.

By creating an account or using the service, you accept these Terms. If you do not accept them, do not use the service. They are supplemented by our privacy policy and our cookie policy.

Jack & Mani is an investigation game whose characters are powered by conversational artificial intelligence. It is played in two modes: an indoor mode (digital), where you carry out the investigation from your screen, and a location-based outdoor mode, which guides you from clue to clue through real places in a city.

The service operates on a "freemium" model: a limited number of investigations is free, and the following investigations are paid. The service evolves regularly; features may be added, changed or removed.

The game is intended for a family audience. The indoor mode is accessible from around the age of 9.

Minors may use the service only under the responsibility and with the authorization of a parent or legal guardian, who accepts these Terms on their behalf and supervises their use. For children under the age of 13, the consent of the holder of parental authority is required to process their data (see the privacy policy).

Any purchase of content must be made or authorized by an adult who has the legal capacity to enter into a contract. By placing an order, you declare that you meet this condition.

Outdoor mode: it involves moving around in public spaces. Any minor player must be accompanied at all times by a responsible adult who ensures their safety. See the "Outdoor mode safety" section.

You can play as a guest (anonymous account) or create an account (with an email and password, or via Google) in order to save your progress and play on several devices. You agree to provide accurate information, to keep your credentials confidential and to report any unauthorized use of your account to us. You are responsible for the activities carried out from your account.

You can stop using the service at any time. You may request the deletion of your account and the associated data by email at info@jackandmani.com; we will act on it within a maximum of 30 days (see the privacy policy).

By using the service, you agree not to:

use it for unlawful purposes or contrary to these Terms;

post, through the chat with the characters, content that is illegal, hateful, violent, sexual in nature involving minors, or otherwise inappropriate;

attempt to circumvent moderation, divert the artificial intelligence from its purpose as a game, extract its instructions or generate prohibited content;

harm the security or proper operation of the service (intrusion, overload, abusive automation, circumventing limitations);

infringe the rights of third parties or of the publisher.

Exchanges with the characters are subject to automated moderation. We may restrict or suspend access in the event of a breach.

The game's characters are powered by artificial intelligence. Their responses are generated automatically from what you type and from the scenario: they are fictional in nature, may be inaccurate, unexpected or surprising, and reflect neither real facts nor the opinions of the publisher.

These responses are in no way advice (medical, legal, financial or otherwise) and must not be the basis for any decision. We do not guarantee their accuracy. The text you type is sent to our AI provider to generate the response, under the conditions described in our privacy policy.

Outdoor mode has you move around in real places. Your safety and that of the people with you take priority over the game. You agree to:

stay aware of your surroundings and not look at the screen while walking; stop to read or interact;

follow the rules of the road and cross only at authorized places;

accompany any minor child at all times and ensure their safety;

stay in public spaces and not enter private, prohibited or dangerous places;

take into account the weather, the lighting and your physical condition.

The trail suggested by the game is purely indicative: you remain solely in control of your movements and choose your route according to the actual conditions. Safety guidelines are reminded to you before each outdoor session.

The service offers paid content under a freemium model: three investigations are offered, after which additional investigations are available for purchase, individually or as a season pack.

The prices of paid content are shown in euros, including all taxes where applicable, before the order is confirmed. Payment is processed by our payment provider or by the app store. We neither receive nor store your payment card details.

Purchased content is digital content supplied immediately. In principle, you have a 14-day right of withdrawal. However, by requesting immediate access to the content, you expressly agree that its performance begins right away and you acknowledge that you lose this right of withdrawal once the content is unlocked. Purchases made through an app store are also subject to that store's terms.

The prices and availability of content may change. In the event of an obvious error in price or description, we reserve the right to correct the information or to cancel the order concerned, informing you and refunding you where applicable.

When you access paid digital content, it must conform to the description we give of it and to what you can legitimately expect from it. In accordance with Belgian and European law on the supply of digital content and services, you benefit from a legal guarantee of conformity: if the purchased content has a lack of conformity, report it to us at info@jackandmani.com so that we can bring it into conformity (correction or replacement) or, failing that, provide an appropriate refund. This legal guarantee applies at no cost to you and independently of any commercial guarantee that may exist.

The entire service and its content (texts, puzzles, characters, visuals, the "Jack & Mani" brand, logos, software) is protected by copyright and trademark law and remains the property of the publisher or its licensors. We grant you a personal, non-exclusive and non-transferable right of use, for private and non-commercial purposes, for the duration of your use of the service.

Any reproduction, distribution, modification or exploitation of the content outside of this framework, without prior written authorization, is prohibited.

We strive to ensure the availability and proper operation of the service, without being able to guarantee uninterrupted access or the absence of errors; interruptions (maintenance, incident, change) may occur. The service may link to third-party sites that we do not control.

Our liability is assessed in accordance with Belgian law. We do not exclude or limit our liability in the event of willful misconduct, gross negligence, or personal injury: no provision of these Terms may be interpreted in that sense. For the rest, and within the limits permitted by law, our liability is limited to direct and foreseeable damages resulting from a breach attributable to us.

In the event of a breach of these Terms, in particular of the usage rules, we may restrict, suspend or close your access, where possible after notice and in a proportionate manner. You, for your part, may stop using the service and request the closure of your account at any time.

The end of access does not affect content already acquired within the permitted limits, nor the clauses which, by their nature, survive (intellectual property, liability, applicable law).

We may change these Terms to reflect the evolution of the service or of regulations. The applicable version is the one in force at the time of your use. In the event of a substantial change, we will inform you by an appropriate means and, where required, obtain your agreement. By continuing to use the service after the new Terms come into force, you accept them.

Force majeure: we cannot be held liable for a breach resulting from an event reasonably beyond our control (failure of a supplier, major technical incident, disaster, measure by the authorities).

Assignment: we may assign or transfer these Terms and the contract, in particular in the event of a reorganization or transfer of business, without reducing your rights; you may not assign your rights and obligations without our prior agreement.

Severability: if a provision of these Terms is found to be invalid or unenforceable, the others remain fully in force; the provision concerned will, as far as possible, be interpreted or replaced so as to achieve its purpose within the limits of the law.

No waiver: failing to exercise or enforce a right provided for in these Terms does not constitute a waiver of that right.

Entire agreement: these Terms, together with the privacy policy and the cookie policy, constitute the agreement between you and the publisher concerning the use of the service.

Language: these Terms are drafted in French; in the event of a translation, the French version prevails.

These Terms are governed by Belgian law, without prejudice to any more protective mandatory provisions of the consumer's country of residence. In the event of a dispute, we invite you to contact us first at info@jackandmani.com to seek an amicable solution.

Failing that, you can use the Consumer Mediation Service (Belgium) free of charge, Boulevard du Roi Albert II 8, 1000 Bruxelles, www.mediationconsommateur.be. The Belgian courts have jurisdiction, subject to the rules protecting consumers.
